Il visto L1 (L-1 Visa) consente a un datore di lavoro statunitense di trasferire un dirigente, un manager o un dipendente specializzato, da un ramo d’azienda straniera alla società statunitense. È possibile trasferire il personale ad una società esistente o di nuova costituzione. Pertanto, se non esiste ancora un business operativo negli Stati Uniti, si può crearne uno e trasferirvi fin da subito il personale. Il volume d’affari ed il settore sono irrilevanti al fine dell’ottenimento del visto, ma dovrà sussistere una relazione fondamentale e qualificante con la nuova attività negli Stati Uniti. Esistono due tipi di visto L1 (L-1 Visa): il visto L1-A per dirigenti e managers e il visto L1-B per dipendenti specializzati.
Vantaggi del visto L1 (L-1 Visa)
- • Non è soggetto a nessuna quota o numero limitato, pertanto, a differenza di altre categorie di visti, non ci sono limiti al numero di visti disponibili per determinati paesi.
- • La tempistica per ottenere questo visto è rapida. Il tempo medio di elaborazione è compreso tra 3-6 mesi, e vi è la possibilità di ottenere una risposta in 15 giorni pagando il supplemento “Premium Processing”.
- • Nucleo familiare. I titolari del visto L1 (L-1 Visa) possono trasferirsi negli Stati Uniti con il coniuge e i figli a carico (questi otterranno il visto L2).
- • Autorizzazione al lavoro negli USA. Ai coniugi del richiedente L1 viene concessa l'autorizzazione a lavorare che consente loro di svolgere qualsiasi attività con qualsiasi datore di lavoro statunitense (anche slegato dalla società L1).
- • Conversione a Carta Verde (Residenza Permanente). È possibile convertire il visto L1 (L-1 Visa)A a Green Card. I criteri del visto L1 (L-1 Visa)A sono molto simili ai criteri per la categoria EB1C per Managers o Dirigenti multinazionali.

1. Consulta un Avvocato Immigratorio
Inizia coinvolgendo un avvocato immigrazione qualificato che ti guiderà attraverso il processo del visto L-1. Valuteranno se il visto L-1 si allinea con i tuoi obiettivi di immigrazione e impiego, risparmiando tempo e garantendo che la tua domanda soddisfi le tue esigenze.
2. Presenta il Modulo I-129: Petizione per un Lavoratore Non Immigrante
Il tuo datore di lavoro, con l'assistenza del tuo avvocato immigrazione, presenta il modulo I-129 a tuo nome. Questa petizione completa include documenti essenziali che mostrano la struttura della tua azienda, la capitalizzazione, la descrizione del lavoro e le tue qualifiche. Una volta approvata, riceverai il modulo I-797 dall'USCIS.
3. Completa l'Applicazione per il Visto DS-160

Partecipa a un'intervista per il visto presso l'Ambasciata o il Consolato degli Stati Uniti nel tuo paese d'origine, dove gli ufficiali consolari valuteranno la tua idoneità per il visto L-1.
