Case Studies: New office L-1A petition approved for an executive from Vietnam
Synopsis
The U.S. company was incorporated in March 2023 to operate a chicken farm in the state of Texas in the first year upon L-1 approval, and later, engage in the distribution of car and automobile accessories. It is considered a "new office" for L-1 purposes since the U.S. business has not been actively operating for more than a year. The company will operate an organic chicken farm, wholesaling chicken meat and eggs to grocery stores. For its second line of business, with the help of its affiliate business in Vietnam, the U.S. company will procure car parts from their worldwide suppliers and engage in the wholesale and retail of these accessories in the United States.
The beneficiary is the founder of the affiliate Vietnamese business which has been operating in the Automotive Distribution and Technical Consulting Industry in Vietnam for more than 10 years. The new office in the U.S. will rely on the support of its affiliate company, and leverage the worldwide business partnerships and connects that the Vietnamese affiliate has developed over a decade.
The beneficiary has been granted a period of authorized L-1 stay of one year on L-1A to kickstart and head the operations of the U.S. company and build a team that will support and elevate him to his executive position within the one-year period.
