Synopsis
Our client invested a little over $100,000 to set up her E-2 Enterprise based in Florida. Her enterprise engages in retail, wholesale, and online sales of women’s swimwear, women’s loungewear, clothing accessories, and artisan goods. The enterprise has a small retail store which also serves as its distribution center. Her company will be an exclusive luxury swimwear brand designed in the U.K.
In applying for an E-2 visa, applicants have to deal with a "Catch 22" or a chicken and egg situation because they have to demonstrate that the enterprise is real and operating or at least imminently operating. Applicants also need to prove that the funds have been irrevocably committed. It may be daunting at first, but there is a way to meet the E-2 requirements and at the same time minimize the risk on your part as an investor.
For our client, it is great that she has been engaged in the same line of business in the U.K. It is also an advantage that she was able to travel to the U.S. on the ESTA to perform permissible business activities in anticipation of her filing of her E-2 application.
