Davies & Associates LLC has unique expertise representing Indonesian nationals in the US immigration process, including the Indonesia EB-5 visa programme, the L-1 intracompany transfer visa, and the E-2 treaty investor visa via Grenada. We also support Indonesian clients with UK immigration and Italian residency and citizenship matters through our London, Edinburgh, Milton Keynes and Florence offices.

Our Jakarta office is led by senior Indonesian lawyers and supported by our regional office in Singapore, allowing us to advise Indonesian clients on the ground, in their language, and with a clear understanding of how Indonesian business, banking and foreign exchange rules translate into US visa applications.

EB-5 Visa Lawyer in Jakarta

EB-5 is the most direct route to a US Green Card for Indonesian investors and their immediate families. Indonesia has no E-2 treaty, but EB-5 has no treaty requirement, so Indonesian citizens can apply directly.

Our dedicated EB-5 Visa Lawyer Jakarta practice is led by an Indonesian-licensed lawyer with banking and bankruptcy law expertise, working alongside our U.S. EB-5 team. We focus particularly on Indonesian source of funds documentation under Bank Indonesia foreign exchange rules — the part of an EB-5 case that most often determines whether a petition is approved.

Indonesian-Speaking Immigration Lawyers

We offer experienced US immigration lawyers who are native Indonesian speakers and who fully understand Indonesian culture, customs and the way business is done in Indonesia. That cultural fluency means faster, clearer advice on the documents, evidence and structures that US consular officers and USCIS adjudicators expect to see — particularly important for the EB-5 visa, where source of funds documentation must reconcile Indonesian banking practice with the U.S. evidentiary standard.

A Physical Presence in Indonesia

Erga Lawyers - our partner firm in JakartaThrough our relationship with Erga Lawyers we are one of the few US immigration firms with an in-country presence in Indonesia. That association keeps our understanding of the Indonesian market current and lets us respond to Indonesian clients “on the ground” and in “real time”. It also means our EB-5 lawyers in Jakarta can deal directly with Indonesian banks, notaries, tax offices and corporate registries on the client’s behalf when assembling source of funds packages.

US Visa Solutions for Indonesian Clients

We design world-class US immigration solutions for Indonesian individuals, investors and businesses. Our team handles the visa categories most relevant to Indonesian clients, alongside the corporate work needed to support them.

EB-5 Immigrant Investor Programme

The Indonesia EB-5 visa is the most direct route to US permanent residence for Indonesian investors and their immediate families. The minimum investment is USD 800,000 in a Targeted Employment Area or rural project, or USD 1.05 million elsewhere. The investor, spouse and unmarried children under 21 are all eligible for Green Cards. Unlike the E-2 visa, EB-5 has no nationality treaty requirement, so Indonesian citizens can apply directly. Our dedicated EB-5 Visa Lawyer Jakarta page covers the Indonesian source of funds questions in detail.

L-1 Intracompany Transferee Visa

The L-1 visa allows an Indonesian company to transfer executives, managers and specialised-knowledge employees to a qualifying US affiliate, parent, subsidiary or branch. Where no US presence yet exists, we routinely help establish one as part of the L-1 strategy. The L-1A category can lead on to a Green Card via EB-1C.

E-2 Treaty Investor Visa (via Grenada)

Indonesia is not currently an E-2 treaty country, so the E-2 visa is not available to Indonesian nationals on the basis of Indonesian citizenship alone. Indonesian investors typically access the E-2 by first obtaining citizenship in a treaty country, most commonly through the Grenada Citizenship by Investment Programme, which can be completed in a matter of months. For investors who want US permanent residence rather than a non-immigrant treaty visa, the EB-5 route from Jakarta is usually the more direct option.

Setting Up a US Business

Many Indonesian visa strategies depend on a properly-structured US entity. Our corporate services team assists with US company formation, banking, tax planning and the operational set-up needed to support an immigration filing.

Indonesia EB-5 Visa — Our Jakarta Practice

For Indonesian investors seeking US permanent residence, EB-5 is usually the most direct route. We run a dedicated EB-5 Visa Lawyer Jakarta practice precisely because Indonesian EB-5 cases turn on issues that are different from EB-5 cases originating in, for example, the UK or France:

Indonesian source of funds is highly regulated

Bank Indonesia and the Financial Services Authority (OJK) supervise cross-border transfers, and Indonesian investors must comply with rules including underlying-transaction documentation under PBI 18/18/2016 and PBI 24/7/2022, the prohibition on rupiah leaving Indonesia, cash export limits, and ongoing LLD reporting obligations. EB-5 source of funds documentation must reconstruct the lawful path of every dollar in line with these rules and the U.S. evidentiary standard. Our Jakarta EB-5 lawyers handle this layer directly.

Indonesian-licensed counsel working with U.S. EB-5 lawyers

EB-5 is a U.S. immigration filing led by U.S. licensed lawyers. The Indonesian-licensed lawyer adds the local layer that makes the source of funds package defensible: dealing with Indonesian banks, notaries, tax offices and corporate registries, and producing documents in the form Indonesian institutions actually issue. Indonesian clients work with one combined practice rather than coordinating two firms themselves. Read more on the EB-5 Visa Lawyer Jakarta page.

EB-5 outcome: Green Card for the whole family

EB-5 leads to U.S. permanent residence for the principal investor, their spouse, and unmarried children under 21. Children can attend U.S. schools and universities at domestic tuition rates after meeting state residency rules. The investor is not required to manage the underlying business day-to-day where they invest through a Regional Center.

Indonesia EB-5 deep-dive: our dedicated EB-5 Jakarta page covers Indonesian source of funds, the I-526E petition, consular processing in Jakarta or Surabaya, and the I-829 conditions removal stage.

Frequently Asked Questions for Indonesian Clients

Who is the EB-5 visa lawyer in Jakarta at Davies & Associates?

Our EB-5 Jakarta practice is led by Rangga Raditya, S.H., M.H., Managing Partner. Rangga is an Indonesian Advocate and Legal Consultant with banking and bankruptcy law expertise that is directly relevant to EB-5 source of funds work. He works alongside our U.S. licensed EB-5 team led by Mark I. Davies, Esq. Full credentials are on the EB-5 Visa Lawyer Jakarta page.

Can Indonesian nationals apply for the EB-5 visa?

Yes. EB-5 has no nationality treaty requirement, so Indonesian citizens can apply directly. EB-5 leads to a US Green Card for the investor, their spouse, and unmarried children under 21. The minimum investment is USD 800,000 in a Targeted Employment Area or rural project, or USD 1.05 million elsewhere. See our EB-5 Visa Lawyer Jakarta page for the Indonesia-specific detail, or our EB-5 visa guide for the full programme overview.

Why does EB-5 source of funds matter so much for Indonesian investors?

Indonesia maintains an active foreign exchange and capital control regime under Bank Indonesia, including underlying-transaction documentation rules (PBI 18/18/2016 and PBI 24/7/2022), prohibitions on the rupiah leaving the country, cash export limits of around USD 8,000 without prior approval, and ongoing LLD reporting on offshore foreign exchange activity. EB-5 source of funds documentation must reconstruct the lawful path of every dollar in line with both Indonesian banking practice and the U.S. evidentiary standard, which is why we lead Indonesian EB-5 cases with an Indonesian-licensed banking lawyer working alongside U.S. counsel. Our EB-5 Visa Lawyer Jakarta page covers this in depth.

Can Indonesian nationals apply for the E-2 Treaty Investor Visa?

Indonesia is not currently an E-2 treaty country, so Indonesian citizens cannot apply for the E-2 visa directly on the basis of Indonesian nationality alone. The most common workaround for Indonesian investors is to first obtain citizenship in an E-2 treaty country, most often through the Grenada Citizenship by Investment Programme, then apply as a Grenadian national. Investors who want US permanent residence rather than a non-immigrant treaty visa often prefer the EB-5 route instead.

Can an Indonesian company transfer staff to the United States?

Yes. An Indonesian company that has a qualifying US affiliate, parent, subsidiary or branch can transfer executives, managers and specialised-knowledge employees to the United States on the L-1 visa. If the Indonesian parent does not yet have a US presence, we frequently help clients establish one as part of the L-1 strategy. The L-1A category for executives and managers can also lead to a Green Card via EB-1C.

Can I meet your team in Singapore instead of Jakarta?

Yes. Indonesian clients are welcome at our Singapore office on Robinson Road, which serves as our regional hub for Southeast Asia. Many Indonesian investors and business owners already travel to Singapore regularly, and meeting there can be convenient when business or family commitments make it the natural choice.

Do I need to travel to the US to start the visa process?

No. The vast majority of the application process is handled from Indonesia or Singapore. Initial consultations, document preparation, business plan drafting and petition filing are all completed remotely or at our regional offices. The in-person interview takes place at the US Embassy in Jakarta or the US Consulate General in Surabaya, and US travel is generally only needed once the visa has been issued.

Can my family come with me on a US investor or work visa?

Yes. Spouses and unmarried children under 21 can accompany the principal applicant on the E-2, L-1 and EB-5 visas. Spouses of E-2 and L-1 visa holders are eligible to work in the United States, and children can attend US schools and universities. EB-5 grants Green Card status to the entire qualifying family.
