Synopsis
Our client from the UK set up a U.S. company offering software development, management, consulting, operations, marketing, and recruitment services. The Company operates across various tech verticals, encompassing manufacturing, recruitment, eCommerce, and social networking. The primary goal of the Company is to provide operational efficiency and strategic management solutions to its portfolio companies and clients. The Company provides its clients with services tailored to improve their internal processes, identify growth opportunities, and develop and expand their businesses in targeted markets.It is interesting to note that that part of our client's investment in the E-2 Company is intellectual property. Our client developed a software application and he assigned the rights to the intangible property to his E-2 company. It should be noted that the Foreign Affairs Manual specifically states that "rights to intangible or intellectual property may also be considered capital assets to the extent to which their value can reasonably be determined. Where no market value is available for a copyright or patent, the value of current publishing or manufacturing contracts generated by the asset may be used. If none exist, the applicant may submit opinions regarding market value from experts in the field in question for consideration."
