  1. The Philippines is an E-2 Treaty Country and Filipinos may be eligible for an E-2 visa that is valid for 5 years based on qualifying investment.
  2. The E-2 Treaty Investor can apply with his/her spouse and children below 21 at the same time. It is also an option for the spouse and the children to apply for the E-2 visa at a later time. The validity of the E-2 visa of the spouse and dependent children will depend on the validity of the E-2 visa of the treaty investor.
  3. While the E-2 visa is a nonimmigrant visa, which means that you must overcome the presumption of immigrant intent by showing ties to your home country, it can be renewed indefinitely for as long as the E-2 Treaty Enterprise is operating.
  4. The spouse and children below 21 do not have to hold the same nationality or passport as the E-2 Treaty Investor.
  5. The spouse on his/her E-2 derivative visa is eligible to work for any U.S. employer without having to apply for a separate Employment Authorization Document.
  6. Children below 21 are eligible to study in the U.S. on their E-2 derivative visas. They may enroll at any U.S. public schools for free or enroll in private educational institutions for a fee as well.
  7. A pending immigrant petition filed on behalf of the Treaty Investor or his or her dependents does not automatically disqualify him/her from getting an E-2 visa.
