Davies & Associates assisted an Australian nurse in obtaining an E-3 work visa to fill the position of Registered Nurse in the Pediatric ICU at a major U.S. hospital.

Historically, it can be difficult to obtain an E-3 or H-1B visa for a nursing position. In the United States nurses can often find employment after obtaining a 2-year Associates Degree. The law related to H-1B and E-3 visas specifies that the job being offered in the U.S. must be a “specialty” occupation, which means that the job is the kind that normally requires a Bachelor’s degree (typically 4 years of study). While our client did hold a BSN from an Australian school, the visa beneficiary must separately prove that the position being filled normally requires a Bachelor’s degree.
The U.S. Bureau of Labor Statistic’s publishes useful information with regards to this type of visa processing. Specifically, a synopsis of the Registered Nurse profession states that the educational requirement for entry into this career is usually only an Associate’s Degree. Thus, in order to have success with an E-3 application for a nurse, you need to provide sufficient evidence to prove that in fact the particular U.S. nursing position being offered requires a Bachelor’s degree.
Upon further evaluation we drafted a persuasive support letter clearly emphasizing legal reasons as to why the Registered Nurse position in the Pediatric ICU did qualify as a “specialty” occupation. This letter was signed by the U.S. hospital seeking to employ the Australian nurse, and was presented at her visa interview at the U.S. consulate in Sydney.
