Synopsis
Our client and his wife from the UK will be able to come in and out of the U.S. within the 5 year period to run their E-2 enterprise. For every entry on the valid E-2 visa, they will be a given a period of two years of authorized stay, but you are not required to stay for the full period of two years. You can plan your stay in the U.S. for every given tax year so that you will not be considered a tax resident of the U.S. Essentially, the E-2 visa gives you a lot of flexibility.
Aside from the flexibility, your spouse and children may also apply for E-2 derivative visas. Your spouse can work for any US employer without having to apply for an Employment Authorized Document and your children may enroll in schools.
Your E-2 enterprise can even file an application for an individual with the same nationality to become an E-2 Treaty Employee. The employee can be an executive, supervisor or someone with special qualifications.
