Case Studies: New office L-1A petition approved for a founder and CEO of the related Vietnamese company
Synopsis
The U.S. petitioning company was incorporated in 2023 and will operate two connected lines of businesses: one involving the import and wholesale of fish sauce; and the other, a chain of Vietnamese Food & Beverage outlets. It is considered a "new office" for L-1 purposes since the U.S. business has not been actively operating for more than a year.The L-1 beneficiary is the founder and CEO of the related Vietnamese company, engaged in the production and wholesale of traditional Vietnamese foods, including fish sauce. The U.S. start-up will import fish sauce produced by its affiliated company abroad and will also offer a wide selection of Vietnamese dishes in their chain of F&B outlets.
The L-1A beneficiary, who will helming the start-up, has been granted a period of one year to set up the U.S. business and build a team that will support him in the new role.
