Synopsis
Our client from the Philippines set up a maintenance services company in New Mexico and applied for E-2 Treaty Investor Visa. His application was approved and he was given an E-2 nonimmigrant visa that is valid for 5 years. This means that he can come in an out of the U.S. within the 5-year period and can stay in the U.S. for a two year period for every entry.
Our Process
The validity of the E-2 visa depends on a reciprocity schedule. For most countries, the
reciprocity schedule is 5 years, but for some countries like Egypt and Jordan, the reciprocity
schedule is only 3 months. E-2 Treaty Investors from these countries will still be given a
two year period of authorized stay upon entry on the valid E-2 visa, but if they depart
the U.S., they will likely have to apply for renew their E-2 visas again.
The spouse and children under 21 of a treaty investor are eligible for derivative visas.
The spouse is now considered to be employment authorized and the children are eligible to study.
The processing time for E-2 Treaty Investor visa at the U.S. Embassy in Manila is quite fast
compared to other locations. The process of preparing an E-2 application can take between
1-2 months. Once the application is ready, the applicant can get an interview scheduled in
a month or even less.
Unlike other visa categories, there is no quota or per country limitation for the E-2 visa
classification, which means that you can apply for the visa anytime.
