Pour être éligibles, les investisseurs doivent injecter des capitaux dans une Nouvelle Entreprise Commerciale (NCE) aux USA. Le montant requis est de :
- 800 000 USD si l'entreprise est située dans une zone d'emploi ciblée (TEA) ou rurale.
- 1 050 000 USD si l'entreprise est située en dehors de ces zones.
L'investissement doit créer ou maintenir au moins 10 emplois à temps plein pour des travailleurs américains qualifiés.

Il existe deux voies principales pour les investisseurs à Paris :
- EB-5 via un Centre Régional : Investissement dans des projets d'envergure gérés par des entités agréées par l'USCIS. Idéal pour ceux qui recherchent une gestion passive.
- EB-5 Direct : Investissement direct dans votre propre entreprise ou une entreprise spécifique sans passer par un centre régional.
