A principal applicant is required to prove that the investment has been irrevocably invested, which means that the purchase price must be paid to the seller already. Essentially, the principal applicant must prove that his or her funds are at risk. The good news is that there is a legal mechanism to meet the legal requirement and at the same time minimize the risk on the part of the treaty investor. If a seller agrees, the purchase of a business can be made contingent on the approval of the visa. With the contingency clause, the purchase price must be placed in an escrow account.
