In Fiscal Year 2022, a total of 3,361 E-2 visas were issued to citizens of Great Britain and Northern Ireland.
One way to qualify for an E-2 visa to buy an existing business in the U.S.
A principal applicant will only need to acquire at least 50% of an existing business for a substantial amount to qualify for an E-2 Treaty Investor visa. It should be noted, however, that when acquiring an existing business, the business must be profitable, must have employees and must have a capacity to hire more employees in the future. A principal applicant is required to prove that the investment has been irrevocably invested, which means that the purchase price must be paid to the seller already. Essentially, the principal applicant must prove that his or her funds are at risk. The good news is that there is a legal mechanism to meet the legal requirement and at the same time minimize the risk on the part of the treaty investor. If a seller agrees, the purchase of a business can be made contingent on the approval of the visa. With the contingency clause, the purchase price must be placed in an escrow account.
